Terms of Service

Flextuma is an SMS gateway platform that lets organisations manage contacts, message templates, and campaigns, and send messages through connected SMS network providers.

• You must provide accurate information when creating an account and keep your login credentials confidential.
• You are responsible for all activity that occurs under your account and your organisation’s account.
• Administrators of an organisation are responsible for the users, roles, and privileges they grant within that organisation.

You agree not to use the Service to:

• Send messages to recipients who have not consented to receive them, or in violation of applicable anti-spam, telecommunications, or data protection laws.
• Send unlawful, fraudulent, deceptive, harassing, or abusive content.
• Attempt to circumvent rate limits, connector restrictions, or security controls.
• Interfere with or disrupt the Service or the SMS networks it connects to.

You are solely responsible for the content of messages you send and for obtaining any required consent from recipients.

The Service is used on a prepaid basis: message and campaign usage is deducted from your organisation's wallet balance. You are responsible for maintaining a sufficient balance to send messages. Fees, once deducted for successfully processed messages, are non-refundable except where required by law.

Message delivery depends on third-party SMS network providers ("connectors") configured on your account. We are not responsible for delays, failures, or content filtering caused by these third parties or by recipient carriers.

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may suspend or modify features for maintenance, security, or operational reasons.

We may suspend or terminate access to the Service for accounts that violate these Terms, including the acceptable use rules above. You may stop using the Service at any time; certain data retention obligations described in our Data Deletion Policy continue to apply after termination.

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, FlexCode Labs is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including losses caused by message delivery failures or third-party provider outages.

These Terms are governed by the laws of [governing jurisdiction to be confirmed], without regard to conflict-of-law principles.

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
